These conditions of use regulate access to, and use of, the various content and services included in or accessible through the web site developed by LECIÑENA, S.A. (hereafter referred to as “LECIÑENA” and located at the address http://www.trailec.com (hereafter referred to as “the web site”).
Registration as a user of the web site implies acceptance, without reservation, of each and every one of the general conditions stated here.
SERVICES PROVIDED VIA THE WEB SITE
The web site will provide the catalogue of products and services offered by Leciñena, information about the road transport of goods sector, and any other service which may be included in the web site in future.
LECIÑENA reserves the right to unilaterally modify the presentation and configuration of the web site, as well as the corresponding services and the conditions for use, without the user being entitled to any form of compensation.
USER OBLIGATIONS
The user is obliged to use the web site, as well as the services connected with it, in a diligent manner, in accordance with the law, moral conduct, public order and the conditions set down in these general conditions. The user must also abstain from using the website in any way which could impede its normal functioning and use by other web site users and their use of the services related to it, and must also abstain from using it in a manner which could harm or damage LECIÑENA’s property and rights, other users or any third party in general.
INTELLECTUAL AND INDUSTRIAL PROPERTY
The user recognises that all the elements of the web site and each one of the services provided via the web site, the information and material contained in it and the structure, selection, arrangement and provision of its contents and the computer programmes used in relation to it are all protected by intellectual and industrial property rights belonging to LECIÑENA itself or to third parties. Except when authorised by LECIÑENA or, should it be the case, by the third parties owning the corresponding rights, or unless it is legally permitted, the user may not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, lend, make available or allow public access by any public communication method to any of the elements referred to in the paragraph above.
The user must use materials, services and information accessed via the use of the web site and each one of the corresponding services only for his own needs, and must not either directly or indirectly make any commercial use of either the services or the materials, elements and information obtained through them.
EXCLUSION OF GUARANTEES
LECIÑENA commits itself to make all necessary effort to ensure the availability and continuity of the web site, as well as the services linked to it. Nevertheless, LECIÑENA cannot guarantee that the web site and the services linked to it will function correctly at all times, or that the user will be able to access them and use them in a rapid, uninterrupted manner, free of errors. Equally, LECIÑENA cannot provide any guarantee with respect to the suitability of the content of the web site or any of the products or services linked to it in terms of satisfying the specific needs of the user.
In relation to the content of the web site, it contains only general information and a general description of the characteristics of products and services, which may vary over time.
PERSONAL DATA PROTECTION
In relation to the regulations set down in Organic Law 15/1999 concerning the protection of data which is personal in character, Leciñena hereby informs the user of the existence of an automated electronic data file for personal data created by and for Leciñena and for which it is responsible, with the purpose of carrying out the maintenance and management of the relationship with the user, as well as for providing information and marketing their products and services or activities related to these.
When a request is made for any of the services related to the web site, Leciñena will ask the user for certain data in order to provide these services. At the time the request is made, the user will be informed about why it is necessary or helpful to collect such data in order to provide the corresponding service. Nevertheless, the failure to provide such data will impede Leciñena from providing all the services connected with such data.
Leciñena hereby informs the user about the possibility of assisting him to exercise his rights to access, rectify, object to or cancel the personal data held by Leciñena. The user’s name and surname(s), his address for notification, a photocopy of his national identity card or passport and details of his request. In all cases, such a request must contain the following data: In the case that the request is being made via a representative, the representative must prove his authority to do so through the provision of appropriate authentic documentation.
MARKETING COMMUNICATIONS
The user agrees that, should he provide Leciñena with his postal address or email address, Leciñena may send him marketing material referring to their products or services either by email, post or any other means. The user is entitled to request at any time that such communication cease. To do so, as well as to make any type of comment or enquiry, the user may contact Leciñena by email at protecciondatos@lecinena.com or by post at Leciñena’s postal address.
COOKIES
LECIÑENA will use “cookies” with the aim of making navigation through the web site easier and to offer a personalised and more flexible service.
“Cookies” are small text files which the server inserts in the folder preconfigured by the user’s computer’s operating system in order to identify him. The cookies installed by LECIÑENA are exclusively associated with anonymous user profiles, without making it possible to access the user’s personal data or the data stored on the hard drive of the user’s computer.
